The Occupational Health and Safety Administration (OSHA), and its state-delegated enforcement authorities, have sought to apply process safety management provisions to certain propane facilities which should be exempted by the retail facility exemption. OSHA has taken action against a number of different propane companies in a variety of states.

While the National Propane Gas Association continues to pursue advocacy to stop OSHA from its illegal enforcement actions taken without proper authority, NPGA may be forced to seek judicial remedies.
